Introduction

This statement (referred to as the "Privacy Policy") provides a thorough description of Pedago's ("Company") practices regarding Personal Data (whose constituents are detailed below) collected through the use of the "Services": Miya Miya website (miyamiya.org) and the mobile application (Miya Miya).

The Privacy Policy indicates the type of data collected, how it is used by the implementers, and the specific considerations taken for children (anyone under the age of 18 years old). The policy also shows the rights that all users of the Services can exercise over the collected data.

Use Consent

If you are above 16 years old, by submitting Personal Data through our Site or Services, you agree to the terms of this Privacy Policy and you expressly consent to the collection, use and disclosure of your Personal Data (listed below) in accordance with this Privacy Policy.

Parental consent for underage users

Most, if not all users of the Miya Miya Services are children (below 18 years of age). As such, the policy abides by the General Data Protection Regulation (GDPR) of the European Union (Regulation 2016/679).

As per point (a) of Article 6(1) of the aforementioned regulation, all personal data for children over the age of 16 can be lawfully processed.

Conditions applicable to child's consent in relation to information society services:

  1. Where point (a) of Article 6 (1) applies, in relation to the offer of information society services directly to a child, the processing of the personal data of a child shall be lawful where the child is at least 16 years old. Where the child is below the age of 16 years, such processing shall be lawful only if and to the extent that consent is given or authorized by the holder of parental responsibility over the child.
  2. Miya Miya shall make reasonable efforts to verify in such cases that consent is given or authorized by the holder of parental responsibility over the child, taking into consideration available technology.

General Data Protection Regulation (GDPR)

Processing of information collected through the services shall be lawful only if and to the extent that at least one of the following applies:

  1. the data subject has given consent to the processing of his or her personal data for one or more specific purposes;
  2. processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
  3. processing is necessary for compliance with a legal obligation to which Miya Miya is subject;
  4. processing is necessary in order to protect the vital interests of the data subject or of another natural person;
  5. processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in Miya Miya;
  6. processing is necessary for the purposes of the legitimate interests pursued by Miya Miya or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

Types of Collected Information

  1. Personal Data

    When registering for a Miya Miya account, you (the "Student" if above 16 years old, or the "Student's Legal Guardian" if below 16 years old) agree to provide the Company with the following Personal Data to be included in our database:

    • Full Name (first and last name);
    • E-mail address;
    • Password for platform log-in;
    • Age;
    • Gender;
    • Country and area of residence;
    • Nationality;
    • Level of education;
    • Academic progress tracking (i.e. lessons completed on the platform and grades);
    • If you are using our Services on your mobile phone, we may collect your phone number and the unique device identification number;
    • While using our Services, you can store preferences like your location, safe search settings, and favorites. We may associate these choices with your ID or the mobile device, and you can edit these preferences at any time in the settings page;
    • When connecting to our Services via a service provider that uniquely identifies your mobile device, we may receive this identification and use it to offer extended services and/or functionality.
  2. Information Collected via Technology

    1. Information Collected by Our Servers:

      To optimize the Service we provide, our servers (at times hosted by a third-part service provider) collect data from you, including your browser type, operating system, Internet Protocol ("IP") address (a number assigned to your computer when you use the Internet, and may differ from each log in), domain name, and/or a date/time stamp for your visit.

    2. Log Files:

      Similar to other websites and online services, we gather and store log files that include IP address, browser type, internet service provider (ISP), referring/exit pages, OS, date/time stamp and clickstream data. The information is used to analyze trends, track user's usage of the site, collect demographic information on the Service's users, and to guide site administration and adjustments to fit the needs of users. For example, some of the information may be collected so that when you visit the Site or the Services again, it will recognize you. As noted in this Privacy Policy, we do not link this automatically-collected data to Personal Data.

    3. Cookies:

      Like many online services, we use cookies to collect information. "Cookies" are small pieces of information that a website sends to your computer's hard drive while you are viewing the website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. This type of information is collected to make the Site more useful to you and to tailor the experience with us to meet your special interests and needs.     4. Pixel Tags:

      We also use "Pixel Tags" (also known as clear Gifs, Web beacons, or Web bugs). These Pixel Tags are tiny graphic images with a unique identifier, whose function is similar to Cookies, which is to track the online movements of our users.

    5. Mobile Services:

      We may also collect non-personal information from your mobile device if you have downloaded our Application. This information is generally used to help us deliver the most relevant information to you. Examples of information that may be collected and used include your geographic location, how you use the Application, and information about the type of device you use. In addition, in the event our Application crashes on your mobile device, we will receive information about your mobile device model software version and device carrier, which allows us to identify and fix bugs and otherwise improve the performance of our Application(s). This information is sent to us as aggregated information and is not traceable to any individual and cannot be used to identify an individual.

    6. Google Analytics:

      We use Google Analytics to analyze trends on how users use the Site. Google Analytics uses Cookies (described above), to track how often you use our services, what sections you visit, and other sites you have used prior to using our Services.

      The information we get from Google Analytics is used to improve our Services. Google Analytics only uses your IP address, and does not link the collected information with your Personal Data.

    7. Location Information:

      If you have enabled location services on your phone, we collect your location information to make a map available to the recipients of your messages showing your location. If you do not want this information collected by us, you can disable location services on your phone.

Use of Collected Personal Data

Pedago uses Personal Data in furtherance of our legitimate interests in operating our Application, Site and Services. More specifically:

  1. General Use

    In general, Personal Data you submit to us is used either to respond to requests that you make, or to aid us in serving you better. We use your Personal Data in the following ways:

    1. facilitate the creation and security of your Account;
    2. identify you as a User of our Services;
    3. provide improved administer our Services;
    4. respond to your requests and feedback;
    5. improve the quality of your experience and interaction with our Services;
    6. send you a welcome email to verify the ownership of the e-mail when signing up to our Services;
    7. send you administrative notification, such as security or support and maintenance advisories messages through e-mail.
    8. Creation of Anonymous Data

We may create Anonymous Data records from Personal Data by excluding information (such as your name) that makes the data personally identifiable to you. We use this Anonymous Data to analyze request and usage patterns so that we may enhance the content of our Services and improve Site navigation. We reserve the right to use Anonymous Data for any purpose and disclose Anonymous Data to third parties in our sole discretion.

Disclosure of Your Personal Data

We disclose your Personal Data as described below and as described elsewhere in this Privacy Policy.

  1. Users

    We will share your Personal data with other Users solely for the purpose of providing the Services.

  2. Third Party Service Providers

    We may share your Personal Data with third party service providers to: provide you with the Services that we offer you through our Site; to conduct quality assurance testing; to facilitate creation of accounts; to provide technical support; and/or to provide other services to the Company. These third-party service providers are required not to use your Personal Data other than to provide the services requested by Company.

  3. Affiliates

    We may use your Personal Data (some or all of it) with our parent company, subsidiaries, joint ventures, or other companies under a common control ("Affiliates"). All Affiliates will be required to honor this Privacy Policy.

  4. Corporate Restructuring

    In case of the negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets, we may share your Personal Data. Also, in case of an insolvency, bankruptcy, or receivership, Personal Data may be transferred as a business asset.

    If another company acquires our Company, business, or assets, then the possession of your Personal Data will pass to that company, but still be covered by the rights and obligations described in this Privacy Policy.

  5. Other Disclosures

    We hold the right to disclose your Personal Data in good faith, while ensuring that any disclosure is necessary as part of: a criminal investigation, to comply with relevant laws, subpoenas and warrants, to protect or defend the rights/property of the Company, Users or the Services, as well as to assist in preventing any violation or potential violation of laws, the Privacy Policy or our Terms of Use.

Your Choices Regarding Usage of Information

You have multiple options regarding the usage of information on our service:

  1. Cookies

    If you decide at any time that you no longer wish to accept Cookies from our Service for any of the purposes described above, then you can instruct your browser, by changing its settings, to stop accepting Cookies or to prompt you before accepting a Cookie from the websites you visit. Consult your browser's technical information. If you do not accept Cookies, however, you may not be able to use all portions of the Service or all functionality of the Service.   2. Changing or Deleting Your Personal Data

    You may change any of your Personal Data in your Account by editing your profile within your Account or by sending an e-mail to us at [email protected]. You may request deletion of your Personal Data by us, and we will use commercially reasonable efforts to honor your request, but please note that we may be required to keep such information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. We may also retain your information for fraud or similar purposes.

  3. Applications

    You can stop all collection of information by the Application by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

Security of Your Information

Company is committed to protecting the security of your Personal Data. We use a variety of industry-standard security technologies and procedures to help protect your Personal Data from unauthorized access, use, or disclosure. We also require you to enter a password to access your Account information. Please do not disclose your Account password to unauthorized people. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while Company uses reasonable efforts to protect your Personal Data, Company cannot guarantee its absolute security.

Changes to This Privacy Policy

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and we will change the "Last Updated" date. You should consult this Privacy Policy regularly for any changes.
